About Zula Path and Nexara Labs

Zula Path is a university application guidance platform that helps Kenyan students identify, research, and apply to universities across 36 countries. Zula Path is a product of Nexara Labs, a business registered in Kenya under the Companies Act (Cap. 486).

Our platform provides tools, resources, country guides, and institutional information to support students throughout the university application process. Zula Path does not operate as an accredited educational institution, a licensed immigration consultant, or an official representative of any university.

Eligibility and Account Registration

To use Zula Path, you must:

• Be at least 16 years of age, or have parental or guardian consent if under 18.
• Provide accurate, current, and complete information during registration.
• Maintain the security of your account credentials and notify us immediately of any unauthorized access.
• Not create accounts on behalf of another person without authorization.

We reserve the right to refuse registration, suspend, or terminate accounts that violate these terms or that we believe were created fraudulently.

Services Provided

Zula Path provides the following services (subject to the plan or access tier you have subscribed to):

• University Discovery: Browsing and filtering of universities across supported countries.
• Application Guidance: Step-by-step country and institution-specific guidance documents.
• Requirements Information: Published entry requirements, deadlines, and eligibility criteria as sourced from official and publicly available channels.
• Document Checklists: Guidance on required application documents.
• Affiliate Links: Where applicable, links to third-party partners, English language test providers, and service providers.

User Responsibilities and Acceptable Use

As a user of Zula Path, you agree not to:

• Misrepresent your identity or qualifications on the platform.
• Scrape, copy, or reproduce platform content for commercial use without written permission.
• Upload unlawful, abusive, defamatory, or fraudulent content.
• Attempt to gain unauthorized access to any part of the platform or its underlying infrastructure.
• Use automated tools (bots, scrapers, scripts) to interact with the platform without authorization.
• Circumvent or interfere with the platform's security features.
• Resell or commercially exploit platform content or features without prior written consent.

You are solely responsible for the accuracy of any information you submit through Zula Path and for any consequences arising from reliance on the platform's guidance.

Payments, Fees, and Refunds

Certain Zula Path features may require payment. Where fees apply:

• All prices are displayed in Kenyan Shillings (KES) unless otherwise specified.
• Payments are processed via M-Pesa, card, or such other methods as we make available.
• Fees are non-refundable unless you are entitled to a refund under Kenyan consumer protection law or where Zula Path has failed to deliver the described service.
• Subscription plans, if offered, will be billed on the stated cycle. You may cancel before the next billing date to avoid further charges.
• We reserve the right to modify pricing with reasonable notice.

Intellectual Property

All content on Zula Path, including but not limited to text, country guides, graphics, logos, platform design, and software, is the intellectual property of Nexara Labs or its licensors and is protected under Kenyan and international intellectual property law.

You are granted a limited, personal, non-exclusive, non-transferable license to access and use Zula Path for your own educational purposes. You may not reproduce, distribute, modify, or create derivative works from platform content without our prior written consent.

User-submitted content (such as profile information or feedback) remains your property. By submitting it, you grant Nexara Labs a non-exclusive license to use such content to operate and improve the platform.

Disclaimer of Warranties

Zula Path is provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable Kenyan law, Nexara Labs makes no warranties, express or implied, including but not limited to:

• The accuracy, completeness, or timeliness of university requirements and deadline information.
• Uninterrupted or error-free operation of the platform.
• That the platform will meet your specific requirements or expectations.
• The suitability of any university or program for your individual circumstances.

University admission requirements, tuition fees, deadlines, and policies are subject to change without notice. You are responsible for independently verifying all critical information before submitting applications.

Limitation of Liability

To the fullest extent permitted by law, Nexara Labs and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Zula Path, including but not limited to:

• Application rejections or missed deadlines resulting from reliance on platform information.
• Loss of data or access.
• Costs incurred for visa applications, travel, or other third-party services.
• Any actions or decisions made based on platform guidance.

Our total liability to you for any claim arising from use of Zula Path shall not exceed the amount paid by you to Zula Path in the three months preceding the claim, or KES 1,000, whichever is greater.

Indemnification

You agree to indemnify, defend, and hold harmless Nexara Labs, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:

• Your breach of these Terms of Service.
• Your violation of any applicable law or third-party right.
• Content or information you submit through the platform.

Termination

We may suspend or terminate your access to Zula Path at our discretion, with or without notice, if we believe you have violated these terms or engaged in conduct harmful to other users or the platform.

You may delete your account at any time. Upon termination, your right to use the platform ceases immediately. Provisions that by their nature should survive termination (including intellectual property, disclaimers, and limitations of liability) shall continue to apply.

Changes to These Terms

We may update these Terms of Service from time to time. Changes will be effective upon posting to the platform. Where changes are material, we will provide notice via email or an in-platform notification. Your continued use of Zula Path after changes take effect constitutes acceptance of the revised terms.

Governing Law and Disputes

These Terms of Service are governed by and construed in accordance with the laws of Kenya. Any dispute arising from or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Kenya.
